US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in the state of Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
